- This agreement will be governed by the
laws of the State of California, within the United States.
- Tunza Internet Products Inc. will give you (the 'reseller')
a 30% commission on the sale price of all subscription packages
sold through a direct referral from any banner, icon, or other
link displayed, used, or advertised by you the sponsor.
- Additionally, you will earn the same RESIDUAL
commission on a monthly basis for the lifetime of your referral.
- Additionally, You will earn a 10% over
ride on all sales from any and all other affiliates referred to
our affiliate program thru you.
- You may not sign up underneath yourself.
No commissions will be paid to affiliates who have previously
signed up. Don't sign up twice, it won't work.
- You cannot earn commissions on your own
sign up. Clicking on your affiliate link and then joining SEB
will not earn you a commission on your own referral.
- This agreement is purely for outlining
commissionable sales generated through your referral. The term,
'sponsor or affiliate', does not imply any formal association
with Tunza Internet Products Inc., other than being a
partner in referring other users. The affiliate does not own
the right to our products, logos or trademarks.
- The Partner is not permitted to represent
themselves as a direct employee of Tunza Internet Products
Inc. The Partner may, advertise or write independent product
reviews for any particular product listed on this web site in
order to increase the effectiveness of the banner or other advertisement.
- Spamming (sending unsolicited email)
is strictly prohibited, and may
result in your account being terminated and all commissions forfeited.
- Although we fully intend to keep the commission
rate as it stands, we reserve the right to alter the rate of
commission at any time without notice. Any credit accumulating
after such change will be at the new rate. i.e. the Affiliate
is not guaranteed to have the same rate as the one started with.
This is not a loophole to defraud you, but a way for us to prepare
for anything unforeseeable in the future. As we see it now, such
change should never be necessary.
- We reserve the right to change the product
prices from time to time which may have an effect on the commissionable
rate.
- The commission will be credited only when
the payment for the sale is cleared. If the buyer issues a charge
back, a check bounces or a credit card transaction is found to
be fraudulent at a later time, the original commission credited
will be deducted from future commissions.
- This system is dependent on a cookie being
placed in the web surfer's computer, in addition a log file is
maintained which records all click thru activity and logs the
affiliate ID along with user infromation. We will not be responsible
for any cookie, or log failure that may result in the user's
clicks going unregistered, although most of the small errors
are corrected by a cross reference to our log files. Some web-surfers
have disabled cookies on their web browser (a very small percentage).
We do try to capture ALL click throughs by cross referencing
all sales with our log files. Although some " Non Capture"
of click thru's could happen, we have never recorded an incident
like this to date.
- The commission will be paid monthly when
resellers commission amounts to US$50.00 or more, and such payment
will be through a check written from a US bank account in US
dollars. We will not be responsible for a sponsor's inability
to cash the check or a loss of amount due to exchange rates.
- We will not accept responsibility for
clearing the check at your financial institution.
- A minimum of $50.00 in commissions is
required before a check will be disbursed. Any commissions which
do not meet the minimum requirement will be rolled over into
the following month until the minimum is achieved.
- Resellers wishing to "cash out"
prior to the minimum will be honored. A $15.00 processing fee
will be deducted from any outstanding commission owed in order
to manually generate a "cash out" check. You may cancel
your association with us at any time.
- We reserve the right to evaluate your
site and terminate individual agreements after notification through
E-mail. In such situations, our sole responsibility ends at issuing
a check corresponding to the outstanding amount in your credit.
No explanation for the termination will necessarily be given.
- Under this program, you are only entitled
to commissions for software sold at searchengineblaster.com.
- We reserve the right to cancel the Affiliate
program without notice. As in the previous case, if this should
ever happen all sponsors will be issued with a check corresponding
to any outstanding amount in their account.
- The Partner is not under any obligation
to keep the banners on their web site. Removal of the banner
may not result in an immediate cessation of credit accumulation.
No correspondence regarding the removal of banner is required
or will necessarily be answered by Hi Tek Internet Software.
- Any correspondence relating to loss of
the check in mail, or inability to cash the check, must be notified
within a reasonable time to let us decide on an alternative payment
method(s).
- Any tax liability on the amount of commission
received will be the sponsor's responsibility. You are not employed
by us nor are you entitled to any benefits normally found in
an employer/employee relationship. You are responsible for claiming
the commissioned earned from this affiliate plan on your tax
return. A 1099 Statement will be issued to you when your commission
reaches US$600.00 or more. International users (outside the USA)
will not receive any tax forms and are responsible for reporting
taxes within their own Country.
- While it is up to the Partner to choose
where the banner or advertisement should appear, it must not
be placed on a page/position that could be defamatory or counter-productive
to Hi Tek Internet Software. If requested by us such banner links
must be removed.
- It should clearly be understood that a
direct correlation between 'click-throughs' (verifiable through
our online stats page) and sales may not exist. All operations
are automatic (or semi-automatic) and hence no valid sales referred
by you will go unrecorded with the exception of the rare instances
listed above.
- We will periodically send out a newsletter
addressing ideas for increasing sales and other issues.
- Affiliate fraudsters will be banned, and reported to the appropriate authorities.
